Eligibility and Trademark License Agreement Clause
Eligibility:
  • Any veteran, active duty, National Guard, or Reserve member of the United States Armed Forces, having served honorably
  • Veterans provide a copy of their Department of Defense Form 214 (DD214) (or equivalent) Active duty members may provide a signed command letter.
  • Applicants must have at least 50% ownership and 50% operation interest in the business that produces the products certified under the Homegrown By Heroes® mark.
  • Any value-added product carrying the Homegrown By Heroes® mark must contain a minimum of 50% farmer veteran produced or grown (non-water) agriculture product. Signed affidavit and source verification may be requested. For example, if an applicant produces salsa, the product would be eligible to be certified under the Homegrown By Heroes® mark if it is infused with farmer veteran-grown tomatoes.
Non-Profit Eligibility:
  • The non-profit operates, co-operates, or has a partnership interest in a working and/or educational farm or agribusiness with the purpose of helping military veterans and active duty service members pursue an agriculturally-based career.A minimum of 50% of the agriculture production and/or education component is geared towards military veterans or active duty service members.
  • Proceeds from the sale of farm products should be included in the cost of operating the non-profit, specifically any efforts aimed at assisting military veterans and/or active duty service members.
  • Certain restrictions apply if the non-profit desires to utilize the Homegrown By Heroes® program and its marketing collateral in its fundraising capacity. Non-profits must be granted approval by Homegrown By Heroes® staff prior to the utilization of Homegrown By Heroes® in any/all fundraising efforts.
  • The non-profit must be in good standing with the IRS.
Trademark License Agreement

The current document serves as a “trademark license agreement” between the applicant and the Farmer Veteran Coalition, the national administrator of the Homegrown By Heroes™ program. Certification under the Homegrown By Heroes™ program is free for eligible members. The terms of this Agreement commence once the Farmer Veteran Coalition receives a signed copy of this agreement or an electronic acknowledgment stating that the applicant agrees to be bound by these terms. By signing this document, the applicant agrees to use the Homegrown By Heroes™ trademark only on agriculturally-based products grown, produced, or value-added from farming operations in which he or she has a minimum 50% ownership and operation interest. Program members are prohibited from using the mark on goods purchased from non-Homegrown By Heroes, third-party farms or businesses. Applicant agrees not to alter the Homegrown By Heroes™ trademark that appears in the attached sheet. Special considerations for alteration may be granted by Farmer Veteran Coalition upon request. Applicant agrees that the Homegrown By Heroes™ mark will not be used in a way that will be detrimental or derogatory to any individual, product, business entity, organization, or agency of government. The right to use the Homegrown By Heroes™ mark is personal to each program member and may not be assigned or transferred to any other individual or entity without prior written consent of the Farmer Veteran Coalition. This Agreement shall continue until terminated by written notice from the Farmer Veteran Coalition or when a program member notifies the Farmer Veteran Coalition that they intend to withdraw from the program. Termination of the agreement shall not affect any rights or remedies of the Farmer Veteran Coalition for any breach of the agreement by a program member. Permission to use the Homegrown By Heroes™ mark may be denied or revoked at any time by the Farmer Veteran Coalition. The Farmer Veteran Coalition is in no way liable for, nor does the Farmer Veteran Coalition guarantee products using this mark. The Homegrown By Heroes™ mark serves only as a promotion vehicle for agriculturally-based products produced by US farmer veterans. Applicants agrees to allow visits to production and/or processing facilities to verify compliance with guidelines established by the Farmer Veteran Coalition. Applicants shall provide a description of products, packaging and proposed marketing materials. When applicable, a label and sample of the product in a finished packaged donning the mark shall be provided. All applicants shall provide a copy of appropriate licenses, health certifications, or records of inspection by appropriate state or federal agency when applicable. To use the Homegrown By Heroes™ mark, the Farmer Veteran Coalition requires an annual update on gross farm sales and the types of crops and/or products produced to be certified under the mark. The Farmer Veteran Coalition will keep this information completely confidential. This information will be used in aggregate as evidence of program performance and effectiveness. If an applicant provides the Farmer Veteran Coalition with any photographs, videos, or stories about their farm, the applicant hereby authorizes the Coalition to use those materials, including the applicant’s image and likeness, to promote the nonprofit activity of the Coalition or the Homegrown By Heroes® program.

By issuance of checking the box and providing your initials below, you - the applicant - express your willingness to be bound by the terms of this trademark license agreement. Furthermore, you agree to release and hold harmless the Farmer Veteran Coalition, its successors and assigns, and its directors, officers, employees, and agents from all claims, demands, damages, losses, charges and causes of action arising or resulting from your participation in the Homegrown By Heroes® program. 

Finally, I grant Farmer Veteran Coalition/Homegrown By Heroes® permission to share my information with MarketMaker (foodmarketmaker.com) so that they may include my business (at no charge to me) in their searchable database of farms and food products. I acknowledge being informed that I may opt out of the database by declining the registration of my business by emailing HBH@farmvetco.org.
