So you want to exhibit at the Fringe . . .
The annual Kansas City Fringe Festival's mission is to support artists, celebrate expression, and engage the Kansas City area community. This 11-day performing and visual arts extravaganza straddles a thin, frayed line between mass appeal and eclectic tastes. The festival consistently draws several thousand visual and performing arts enthusiasts, who come to experience and contribute to exciting avant-garde arts and entertainment each summer. We welcome artists of all levels of creative experience to contribute and participate in our vision of innovative performance and visual arts


This will be the fourth year our Festival Headquarters and Family Friendly Visual Arts Exhibit will be held at one of Kansas City's most prominent landmarks, Union Station. In addition, we are excited to be continuing our Aquarius adult-themed visual arts show. Also, we encourage our visual artists to participate in our exciting FringePrize and Iron Artist competitions.

Applying to Fringe

It's very simple - just read this info, then fill out this online application. Submit this form and several examples of the body of work intended to be exhibited. (Images submitted must be accurate representations of the work you plan to exhibit and/or sell at the show. Please submit 3-10 representative images.) Please read all information thoroughly before you apply. The guidelines and application are your contract with the KC Fringe. Application is due by April 30, 2017.


At the end of the application period all artwork submitted will be reviewed. If your artwork is chosen for display at one of the the 2017 Fringe Festival Visual Arts venues a gallery fee of $100 will be due at that time. Also, if any of your artwork displayed sells during the duration of Fringe the commission fee will be 10% of the sale. This gets you prime space in the Union Station grand gallery and/or our adult themed gallery, a full-force marketing campaign, and a volunteer team who will happily put any interested art collectors in contact with you.


The 2017 KC Visual Arts Fringe runs Sunday, July 16 through Sunday, July 30. Plan on your work being exhibited for the entire festival's duration. It is required that each exhibiting artist volunteer at least four hours of their time with the Fringe Festival either keeping an eye on the shows, helping in the 411 Boutique or helping to set up/take down the shows.

Please check your email regularly as this is the only way the Fringe will communicate with you. The primary contact is responsible for turning in all paperwork for everyone involved with that company.

Exhibit/Artist Information:


We need a description of about 50 words for publication in the printed program and the Web site. (If you'd like to give us a longer description to give us a better feel, please do so — but also be sure to give us the shorter one that we can use in promotional materials.) 

Each Artist will be assigned a set amount of exhibit space based on the information and dimensions provided. There will be no alterations to the allotted space once the festival has begun. 


The number of pieces you exhibit will be limited based on venue requirements. You will be notified pre-festival if your exhibit exceeds those requirements. REMEMBER: If you are submitting more than one piece, we will do our best to accommodate your needs, keeping in mind the needs of your fellow artists.

FEE PAYMENT:

If accepted, the Acceptance Fee of $100 is due by June 15, 2017. You will be notified of payment options upon acceptance. If we do not receive this fee from you by June 15, 2017 your place in the show(s) will be revoked.

General Technical Information:

1. All artists must work within the confines of their assigned space. Pre-existing lighting and stage setup cannot be changed.


2. Please bear in mind that you will be working under very different conditions than a normal gallery. Please plan accordingly and remember to have fun and be flexible!


3. You will have one volunteer on hand for all visual arts questions and to help with the management of sales.


4. ALL ARTWORK MUST BE PREPARED FOR DISPLAY. We supply hanging or other fixative materials for exhibit. If you have special needs please communicate with Coordination team prior to festival.


5. Artists MUST adhere to all rules set by the gallery/exhibit venue. You will receive special instructions pre-festival. Any artist who cannot respect the gallery/exhibit venue’s rules will be asked to remove their work from the Fringe. No refunds, no exception.


6. The overall look and feel of the show will be decided by The KC Fringe Festival in partnership with Union Station and Aquarius. The venue and/or festival reserves all rights to remove any art for any reason.


7. There is an allotted “Drop Off/Check In” time frame. You will be notified of this time frame pre-festival. If your work isn't there on time, you will be considered a "Stand-By Artist" and we will do our best to accommodate your work.

The KC Fringe is unjuried and uncensored.  Exhibit slots are filled on a first come, first served basis.  We reserve the right to refuse any application without providing explanation for any reason. 


Signed Agreement:

By submitting this application you, hereafter referred to as THE ARTIST, are agreeing to this contract and all of its stipulations. This agreement between THE ARTIST and KC Creates, hereafter referred to as KC FRINGE, supersedes any other verbal or written agreement in regards to any works of visual art submitted or donated to KC FRINGE.

KC FRINGE reserves the right to make use of any images submitted by THE ARTIST in promotional and informational print. This includes, but is not limited to, any image provided with applications as well as any image emailed to a kcfringe.org email addresses, or images submitted through file sharing tools such as Dropbox or Google Drive. KC FRINGE will make every effort to protect THE ARTIST’s rights by limiting any internet posting of THE ARTIST’s work to 72 dpi low resolution images with watermarks containing THE ARTIST’s name, and that the image was provided for the Kansas City Fringe Festival.


KC FRINGE, and by extension any site serving as a venue for KC FRINGE, reserve the right not to display any piece of art without reason or explanation. THE ARTIST should provide images of body of work (i.e. 3-10 images representative of your work) intended for display at time of application so all sites may choose which pieces they will hang. The artwork will be reviewed by the venue prior to hanging. We have two galleries – a family friendly gallery at Union Station and an Aquarius adult exhibit space. The family friendly show is subject to review by Union Station who reserve the right to revoke or accept any piece for any reason subject to their guidelines. If an image is not submitted and selected, the artwork will not be allowed in the show.


Prior to setup at any gallery, THE ARTIST will be required to fill out a form listing all artwork they are hanging and its worth. This document will contain a show start and end date time duration during which time all pieces of art listed on the document must be left with the gallery for display if the gallery so desires. No piece can be taken out of the gallery prior to the end date of the show. If THE ARTIST sells a piece during the show, THE ARTIST must wait until after the show to turn the artwork over to the buyer. The exception to this rule is any artwork or prints for sale in the Fringe 411 Boutique. KC FRINGE will not turn over artwork to any buyer; it is THE ARTIST’s responsibility to conduct that transaction. KC FRINGE will not make any attempt to sell the artwork, though KC FRINGE volunteers will collect and pass along contact information from interested parties. It is THE ARTIST’s responsibility to pick up the artwork, or make special arrangements with KC FRINGE to store the artwork when a show closes. Any unclaimed artwork will be considered a donation if left unclaimed for 30 days without contact from THE ARTIST. KC FRINGE accepts all liability for the protection and condition of the artwork displayed in a KC FRINGE show from the start date to the end date of that show. KC FRINGE will not accept any liability for unclaimed artwork outside of the gallery show’s running dates.


Upon acceptance into the show you will be subject to a gallery fee of $100 due by June 15, 2017. This fee is non negotiable and non refundable. You will not be in the show or program if this fee is not paid in full.
The gallery fee will be processed upon receipt. If the artist makes any sale during the duration of the festival of artwork displayed at the festival, KC FRINGE will collect 10%. Your 10% commission pays for prime gallery space at Union Station and Aquarius as well as marketing. KC FRINGE is an all-volunteer organization. 

Cancellations are accepted only from the Primary Contact, and only in writing. Artists that withdraw after June 15th forfeit their acceptance fee. All parties agree to adhere to the laws of Missouri, the ordinances of the City of Kansas City, Missouri, and the policies and procedures of the KC Fringe Festival, stated within this document. The KC Fringe Festival reserves the right to cancel any contracts not adhering to this agreement.

Representations and Warranties

1. Artist represents and warrants that

i. Artist has full power and authority to enter into this Agreement and perform all of its obligations hereunder;

ii. The execution, delivery and performance of this Agreement will not violate the provisions of any agreement to which it is a party or by which it is bound;

iii. the Artwork is wholly original with Artist and will not infringe or violate the trademark, trade name, copyright, right of privacy or publiKC Fringe, property rights or any other right of any third party

iv. No third party has any interest in Abandoned Artwork described in Section E.

Grant of License. Artist hereby grants to KC Fringe a revocable, non-exclusive, non-transferable, royalty-free license to do the following:

1. Exhibit the Artwork to the public in the Gallery;

2. Photograph the Artwork;

3. Reproduce the Artwork in KC Fringe publications or marketing materials;

4. Sub-license reproductions of the Artwork for the purposes of distribution through media outlets including, but not limited to newspapers, periodicals, and broadcast news provided, however, that any such sublicensed reproduction must be credited “courtesy of [Artist’s name]”; and

5. Allow the public to photograph the Artwork unless otherwise notified by Artist at least three weeks before the exhibition of the Artwork at the Gallery begins.

Term and Termination

1. The term of this Agreement begins on the date this Agreement is agreed to by Artist and ends fifteen (15)days after the end of the exhibition of the Artwork at the Gallery, indemnification survives the agreement for a period of 60 months.

2. KC Fringe may terminate this Agreement at any time and for any reason.

3. Either party may terminate this Agreement upon ninety (90) days written notice to the other Party.

Indemnification, Limitation of Liability, and Waiver

1. Artist agrees to indemnify, defend, and hold harmless the KC Fringe and/or all of its respective employees, agents, elected officials, successors, and assigns (the “Indemnified Parties”) from and against all losses, claims, damages, costs, causes of action, or liability of every kind and character including reasonable attorney’s fees and costs (together, “Claims”) arising out or of in any way connected with this Agreement including, without limitation, (i) the exhibition or sale of the artwork, (ii) Artist’s breach of any representation, warranty, covenant, or obligation contained in this Agreement, and (iii) any claim of ownership or interest in Abandoned Artwork.

2. Except as expressly provided in Section B(3) of this Agreement, Artist, on behalf of Artist, Artist’s heirs, successors, and assigns, hereby waives, releases and relinquishes all Claims that Artist may have against the Indemnified Parties arising from or related to Artist’s performance of this Agreement. Artist voluntarily assumes all risks of any and all injuries, harm or loss of life that may result from performance of this Agreement. WITHOUT LIMITING THE FOREGOING, UNDER NO CIRCUMSTANCES SHALL THE INDEMNIFIED PARTIES BE LIABLE TO ARTIST FOR ANY SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS.

H. Relationship of the Parties. The relationship between KC Fringe and Artist is not one of employer and employee, principal and agent, joint venture, or partnership. Artist acknowledges and agrees that Artist is responsible for paying all taxes related to the any money payable to Artist hereunder and that KC Fringe will not withhold any money for payments which Artist is required to make pursuant to any applicable law, governmental regulation, rule or order.

Severability. If any provision of this Agreement is illegal or unenforceable, that provision is severed from this Agreement and the other provisions remain in force.

Governing Law and Venue. This Agreement is to be governed by and construed in accordance with the laws of the State of Missouri, without regard to choice of law rules. The Parties consent to the exclusive jurisdiction and venue of the federal and state courts located in Jackson County, Missouri, waive any objection thereto, and agree that any dispute arising under or related to this Agreement shall be brought therein.

Modification. This agreement may only be modified or amended by a signed, written agreement between the Parties. Waiver of any provision of this Agreement shall not constitute a waiver of the right to later enforce that provision or any other provision of this Agreement.

Entire Agreement. This Agreement states the full agreement between the parties and supersedes all prior negotiations and agreements with respect to the subject matter of this Agreement.
