In consideration for receiving permission from The Nature Conservancy and the Mountains to Sound Greenway Trust (hereinafter &quot;the hosts&quot;) to participate in the field trip or event described below (the “Field Trip”), I agree and accept the following:  <ol><li style="text-align: justify;">I declare that I am in sufficient and appropriate physical and mental condition to participate in the Field Trip and that I do not have any type of injury, illness, or allergy that could manifest or worsen as a result of my participation. </li><li style="text-align: justify;"> I understand the security risks, type of activities, methods of transportation and the nature of the terrain and/or bodies of water that may be encountered during the Field Trip in which I will be participating and I am capable of safely undertaking this Field Trip. </li><li style="text-align: justify;"> I understand all of the risks involved in taking this Field Trip and agree to take all reasonable precautions and follow any safety instruction to avoid injury to myself, my belongings, and others as well as damage to property of third parties.</li><li style="text-align: justify;"> I am engaging in the Field Trip at my own risk, and acknowledge that the hosts make no warranties or representations, express or implied, regarding the condition or safety of the terrain, the means of transportation used, or the equipment provided by the hosts during the Field Trip.</li><li style="text-align: justify;"> On behalf of myself, my heirs, successors and assigns, I hereby forever release, indemnify and hold the hosts, their affiliates, their officers, directors, employees, volunteers, representatives and agents (the “Released Parties”), harmless from and against any and all responsibility with respect to direct, indirect, incidental, consequential, special, economic, or punitive damages that might result from my participation in the Field Trip and I renounce the exercise of any claim, suit, cause of action or claim for liabilities, losses, damages (including personal injury and/or death), costs (including legal costs) and expenses (collectively, the “Losses”) arising from or in any way related to my participation in the Field Trip, directly or indirectly, including but not limited to any of the excursions in whatever form of transportation. I intend this release to be effective, regardless of whether the claim of liability is asserted in negligence, strict liability in tort, or other theory of recovery. </li><li style="text-align: justify;"> The present Waiver of Liability covers all potential Losses that I may suffer as a result of the active or passive negligence of any of the Released Parties. I UNDERSTAND AND AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, I HEREBY RELEASE AND EXONERATE EACH OF THE RELEASED PARTIES FOR THE CONSEQUENCES OF THEIR NEGLIGENCE, EVEN IF THEIR NEGLIGENCE CAUSED PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE.</li><li style="text-align: justify;"> I agree to go into only those areas authorized by the host, to comply with all rules as well as instructions from the host and any contractors with respect to the Field Trip. </li><li> I have sufficient insurance with coverage for any emergency or medical situation that may arise as a result of my participation in the Field Trip. I acknowledge that I am responsible for the costs of accident and/or health insurance. I understand that the hosts shall not be responsible for the applicability or coverage of my insurance and, furthermore, the hosts shall not be responsible for providing any insurance on my behalf.</li><li>COVID-19 ACKNOWLEDGEMENT AND WAIVER</li></ol> <ol><li>I certify that I will have current and active health insurance during the term of the Field Trip. <ol><li>I acknowledge that COVID-19 is a highly contagious disease, is the source of a global pandemic, that information about COVID-19 is rapidly changing, and at this time there is no readily available or consistent treatment or cure for COVID-19. </li><li>I acknowledge that I may be exposed to COVID-19 or other illnesses by participating in the Field Trip, and I assume the risk of exposure to COVID-19 or other illnesses and waive all claims against the Conservancy with respect to exposure to COVID-19 or other illnesses. </li><li>I acknowledge that if I develop COVID-19 Symptoms during my participation in the Field Trip or test positive for COVID-19, the Conservancy may notify those with whom I have been in contact and government officials, as appropriate. </li><li>I agree to comply with Executive Orders, directives and related guidance issued in relation to the COVID-19 pandemic (“COVID-19 Requirements”). I also agree to follow relevant CDC and state department of health guidelines on COVID-19 and adopt all appropriate safeguards to ensure my safety and the safety of any third parties with whom I come into contact in the context of the Field Trip (“COVID-19 Safety Measures”).  If I am concerned at any point that I am not able to participate in the Field Trip in a manner that is compliant with COVID-19 Requirements and COVID-19 Safety Measures, I agree to notify the Conservancy immediately.</li><li>I understand that I can obtain further information about COVID-19 at <a href="https://www.cdc.gov/coronavirus/2019-ncov/index.html?CDC_AA_refVal=https%3A%2F%2Fwww.cdc.gov%2Fcoronavirus%2Findex.html" target="_blank" style="font-size: 11px;">cdc.gov/coronavirus/</a> and <a href="https://www.doh.wa.gov/Emergencies/COVID19" target="_blank" style="font-size: 11px;">https://www.doh.wa.gov/Emergencies/COVID19</a> </li><li>I agree to comply with COVID-19 protocols and directions provided to me by the hosts. I acknowledge and agree that they make no representation or warranty that by following such protocols or directions from the hosts that I will be protected from exposure to COVID-19. </li></ol></li></ol> AFTER HAVING READ, UNDERSTOOD AND ACCEPTED THE PROVISIONS OF THIS WAIVER OF LIABILITY, I hereby state my intention to assume all responsibility and all risks involved with the Field Trip and to indemnify the hosts from any and all liability to the maximum extent allowed by law. I further understand that I am giving up substantial rights and that I do so freely and voluntarily, without any coercion. My legal representatives, administrators and/or heirs are bound by my consent. I am at least 18 years of age, or, if I am not 18 years of age, the signature and consent of my parent or legal guardian is included below.
