Volunteer Waivers & Agreements


The Youth Volunteer Waiver must be read and signed by a parent or legal guardian of any volunteer under the age of 19 who wishes to volunteer with the Community Food Bank of Central Alabama.
Adult Volunteer Waiver Agreement
I wish to volunteer my services to various projects through you, the Community Food Bank of Central Alabama, an Alabama nonprofit corporation (“Food Bank”).  In consideration of your locating, arranging, coordinating and/or making available volunteer opportunities, I hereby agree and release you as follows:

I acknowledge and agree that the nature of the volunteer services which are typically performed by Food Bank volunteers, and which may be performed by me as a Food Bank volunteer, may involve (a) physical activity (including without limitation work with heavy tools and materials), (b) contact with unidentified and unfamiliar persons, (c) travel to and from various unspecified locations, and (d) other potential risk of injury. Notwithstanding the preceding sentence, I willingly and freely agree to volunteer and hereby assume any and all risk, with respect to any liability of Food Bank for such risk, including without limitation risk of any accident or injury to person or property which I may sustain in connection with my participation as a Food Bank volunteer or in any Food Bank related project or activity. If ill, I willingly agree to refrain from participating in any and all activities pertaining to my assignment. I accept to disclose any recent history of traveling to areas of communicable disease, and accept that this may disqualify my participation in volunteer activity at the Food Bank.

The agreement hereby releases you and your directors, officers, partners, agents, employees, successors, assigns, licensees, sponsors, donors, volunteers, representatives, guests and affiliates (collectively, the "Food Bank Related Parties") from and covenants not to sue you or any Food Bank Related Party for, any and all claims and causes of action, whether known or unknown, arising out of, based upon or relating to my participation as a Food Bank volunteer or in any Food Bank related activity or project.


Volunteer Assumption of Risk, Waiver of Liability & COVID-19 Agreement

I attest that 
  • I am not experiencing any symptoms of illness such as a fever, cough, or shortness of breath. If I develop these symptoms, I agree that I will cancel my shift before arriving at the Food Bank, as far in advance as possible.
  • I am aware that I must follow the safety and hygiene protocols that have been implemented by the Community Food Bank and that are posted onsite for my review.
 
I attest that:
  • I have not traveled internationally in the past 14 days.
  • I have not traveled to a highly-impacted area within the United States in the past 14 days.
  • I do not believe that I have been exposed to a person with a confirmed or suspected case of COVID-19.
  • I have not been diagnosed with COVID-19 and not yet cleared as non-contagious by state or local public health authorities
  • I am following recommended guidelines as much as possible - practicing social distancing by participating in group activities of fewer than 10, trying to maintain separation of six feet from others, and otherwise limiting my exposure to the coronavirus.
Assumption of Risk and Waiver of Liability

I acknowledge that I have voluntarily applied to the Community Food Bank of Central Alabama’s volunteer program.  I understand that the scope of my volunteer relationship with the Community Food Bank is limited to a volunteer position and that no compensation is expected in return for services provided by me; that the Community Food Bank will not provide any benefits traditionally associated with employment; and that I am responsible for my own insurance coverage in the event of illness or personal injury as a result of my services to the Community Food Bank.

I understand that my volunteer activities with the Food Bank may include activities that could be hazardous to me, including but not limited to packing, loading, unloading and carrying heavy items, transportation to and from work sites, and exposure to people with infectious diseases. I fully understand and appreciate the risks that are inherent to my volunteer activities. I hereby assume the risk of bodily injury, illness, death, medical treatment and property damage resulting from my volunteer activities, even if resulting from the negligence of Community Food Bank or its officers, directors, employees or agents. 

I hereby release, discharge and agree to indemnify and hold the Community Food Bank of Central Alabama harmless from, and waive on behalf of myself and my heirs and personal representatives and any minors I am responsible for who volunteer with me, any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the Community Food Bank, or that may otherwise arise in any way in connection with any voluntary activities with, or for the Community Food Bank.  I understand that this release discharges Community Food Bank from any liability or claim that I or my heirs, personal representatives or minors I am responsible for may have against Community Food Bank with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from or in connection with my volunteer activities.  This liability waiver and release extends to the Community Food Bank together with all of its officers, directors, affiliates, employees and agents. 

I agree that this release will be governed by Alabama law and that the exclusive venue for any dispute arising from this release will be a court of competent jurisdiction sitting in Birmingham, Alabama.

I understand that the nature of my efforts will be purely voluntary and not for any monetary gain. I recognize that all of my time and effort is for charitable causes and I hereby further release the Food Bank from any claim by me, my successors, and assigns for compensation and remuneration. I further irrevocably grant to Food Bank, its assigns and successors, my consent and full right to use my name, photograph, likeness, image, voice and biography in any and all media, publications, advertising, and publicity, in connection with my participation hereunder.

This release shall insure to your benefit, as well as to the benefit of your successors, licensee, agents, employees, affiliates and assigns. This release shall be governed by the laws of the State of Alabama.

CFBCA Minor Policy & Agreements
Volunteers under the age of 16 years old must be accompanied by at least one adult for every six youth present. Children under the age of 8 years old cannot volunteer in the warehouse due to safety concerns.


For volunteering offsite (ie. at a Mobile Pantry distribution):

Volunteers under the age of 18 years old must be accompanied by at least one adult for every three youth present. Children under the age of 8 years old cannot volunteer offsite with the Food Bank due to safety concerns.

CFBCA Youth/Minor Volunteer Waiver Agreement

NOTICE TO PARENT/GUARDIAN 
It is a condition to the Child's participation in volunteering at the Community Food Bank of Central Alabama that you, the undersigned Parent/Guardian of the Child, must carefully read and understand this document and sign it to acknowledge that you have read and understand it and that you understand that the Child's participation as a volunteer will expose the Child to risks of harm and that you accept full responsibility for exposing the Child to such risks. 

PICK-UP PERMISSION 
I understand that it is my responsibility to pick-up or to make suitable arrangements for the pick-up of the Child, immediately on completion of the volunteer shift, and to communicate clearly and effectively to Community Food Bank of Central Alabama staff, prior to beginning the volunteer shift, any special instructions regarding the pick-up of the Child on completion of the volunteer shift.

PHOTO/ MEDIA WAVER 
I grant the Community Food Bank of Central Alabama my consent and full right to use the Child’s name, photograph, likeness, image, voice, and biography in any and all media, publications, advertising, and publicity, in connection with their participation hereunder.

PARENT/GUARDIAN RESPONSIBILITY FOR CHILD 
I, the undersigned Parent/Guardian of the Child, understand and accept that, by allowing my Child to volunteer with the Community Food Bank of Central Alabama, it is my responsibility (1) to ensure that I consider and understand the risks, dangers, hazards and consequences of injury inherent in volunteering in a warehouse environment, (2) to determine, taking into consideration those risks and the Child's behavioral characteristics, physical health and abilities, whether the Child should be allowed to participate as volunteer, (3) to ensure that the Child is appropriately covered by medical insurance for any harm occurring while volunteering and (4) to provide emergency medical information regarding the Child as required in this document. 

AWARENESS OF RISK 
I am aware of and now freely accept and assume responsibility for all risks to the child in connection with participation in volunteering, including as follows:
  1. The Child's participation as Food Bank volunteer, even if the Child possesses behavioral characteristics, physical health and abilities appropriate for volunteering, poses risks of harm to the Child; 
  2. The nature of volunteering is such that the Community Food Bank of Central Alabama cannot identify all risks associated with volunteering and cannot guarantee that Food Bank staff participating with volunteers will not make errors therein or that other children participating in the activities will not cause injuries therein others that staff can or might be able to prevent. 

I, the undersigned parent/guardian, am the parent and/or legal guardian of the child and I hereby consent to their participation as a volunteer, and, in return for the Community Food Bank of Central Alabama allowing the child to participate as a volunteer: 
  1. I NOW WAIVE ALL LEGAL RIGHTS TO SUE AND ANY AND ALL CLAIMS which I or my successors and assigns may have against the Community Food Bank of Central Alabama in connection with any loss, injury, damage or expense that I may suffer, incur or experience in connection with the Child's participation as a volunteer;
  2. I HEREBY RELEASE the Community Food Bank of Central Alabama from any and all liability for any complaints, demands, claims, actions, suits, judgements and orders for, or with respect to, any and all losses, injuries, damage or expenses i may suffer, incur, or experience in connection with the Child's participation as a volunteer;
  3. I AGREE TO INDEMNIFY the Community Food Bank of Central Alabama for, and hold it harmless from, any and all losses, injuries, damages and expenses of judgments and order against it with respect to any and all losses, injuries, damages or expenses of any kind anyone else may suffer, incur or experience to the extent they or any of them may arise from, or in connection with my conduct or the Child's conduct in, or with respect to their participation as a Food Bank volunteer.
