Assumption of Risk and Waiver of Liability:
Drive Through Events During Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of large groups of people.
Blue Star Families (BSF) has put in place preventative measures to reduce the spread of COVID-19; however, Blue Star Families cannot guarantee that you will not become infected with COVID-19. Blue Star Families adheres to the recommendations of the Centers for Disease Control and Prevention (CDC), Occupational Safety & Health Administration (OSHA), and other applicable federal, state and local regulations and guidelines for a safe, clean, and healthy environment. As such, Blue Star Families has provided the following personal protective equipment and precautionary measures to employees and volunteers:
Facial Coverings
Facial coverings will be provided to all employees and volunteers
Employees and volunteers may choose to wear their own facial covering; all facial coverings must cover the employee’s nose and mouth at all times where employees cannot adequately follow social distancing protocols
Employees and volunteers are responsible for maintaining the cleanliness of their facial coverings
Employees and volunteers are required to wear a facial covering where social distancing is impossible or impracticable
Disposable facial coverings will be available in bulk
Gloves
Hand Hygiene
Follow normal preventive actions while at work and home, including cleaning hands and avoiding touching eyes, nose, or mouth with unwashed hands
Hand Sanitizer and sanitizing wipes will be available for employees and volunteers
Additional Guidance
Employees and volunteers are required to take their temperature as well as anyone in their party prior to reporting to a BSF function or event. Anyone with a temperature of 100.4F should stay home.
BSF signage and ground markings have been provided to help employees, volunteers, and guests better navigate common areas while practicing physical distancing while at BSF Events.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending performing work on behalf of Blue Star Families and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, employees, customers, visitors, volunteers, and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my family may experience or incur in connection with my performance of services in the ordinary course at Blue Star Families (“Claims”). Accordingly, I hereby release, covenant not to sue, discharge, and hold harmless Blue Star Families, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Blue Star Families, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after the performance of services on behalf of Blue Star Families.
