Institute Release and Waiver

PLEASE READ THE FOLLOWING RELEASE & WAIVER CAREFULLY

I understand and agree that I am voluntarily participating in gardening and other activities at the property managed by The Food Project, Inc. (the “Food Project”). I understand and agree that I am participating at my own risk, that gardening can be dangerous, and I accept all of the risks of doing so, including entering and exiting the Property and potential dangers at the Property.  I do not have any condition that would impair or restrict my ability to garden or to participate in other activities on or to be on the Property and I will not enter or use the Property if I develop such a condition.

In consideration of being permitted to access or garden at the Property, I hereby assume all responsibility for any and all risk of bodily injury or property damage that I may sustain while entering, exiting or being on the Property, including activity of any nature, including the use of equipment.  I, for myself, my successors in interest, heirs, executors, administrators, assigns and representatives hereby release, discharge and covenant not to sue The Food Project,  its officers, directors, employees, agents, contractors and volunteers and their respective representatives, heirs, successors, and assigns (be they individuals or organizations), together with their respective insurers, sponsors, lessors and lessees (collectively, “Released Persons”), of and from any and all claims which I or my successors, heirs, executors, administrators, assigns and representatives ever may have against any of the Released Persons, on account of, by reason of or arising in connection with the Property or my participation in any Food Project activities, and hereby waive, discharge and release all liability, claims, damages, actions, demands and causes of action whatsoever on account of any loss, damage or injury to person (including death) or property and any other loss or inconvenience whatsoever, suffered by me at any time hereafter arising out of my participation in any Food Project activity or my use of or presence at the Property or otherwise related to the Property or the Food Project (collectively, “Liabilities”).  I waive any relief that might otherwise be available with respect to such Liabilities and covenant not to sue any of the Released Persons.

I UNDERSTAND THAT THIS RELEASE DISCHARGES THE FOOD PROJECT AND ITS AFFILIATES FROM ANY LIABILITY OR CLAIM THAT I MAY HAVE AGAINST THEM WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR PROPERTY LOSS THAT MAY RESULT FROM ACTIVITIES ON OR RELATED TO THE PROPERTY, WHETHER CAUSED BY THE NEGLIGENCE OF THE FOOD PROJECT OR OTHERWISE.

I expressly agree that this agreement is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Massachusetts, and that if any portion is held invalid, I agree that the balance shall continue in full legal force and effect.

By entering my name below, I hereby agree to the terms and conditions set forth above.
