Hurricane Ian Debris Removal Program

The Florida Division of Emergency Management (FDEM) is accepting applications for the Hurricane Ian Debris Cleanup Program to assist with the removal of debris, including displaced and abandoned vehicles, vessels, and other titled property from qualifying private and commercial properties, as well as waterways throughout participating counties.  

Submit an application if you (1) own a property in an affected county and would like to request the removal of the debris on that property or (2) if you lost a vehicle, vessel, or other titled property due to Hurricane Ian and would like to report the vehicle, vessel or other titled property missing.

By signing below, I hereby certify that I am the owner of the property described below (“Property”) or the Property owner’s authorized agent and that I have the legal authority to enter into this Right of Entry Agreement (“Agreement”).

Right of Entry: I am granting permission to representatives of the United States, the State of Florida, the County, the municipality, their agents, contractors and subcontractors (“Entities”) to enter upon or pass through the Property. This Right of Entry (ROE) includes the right of ingress and egress on other lands. I agree that Entities may hereafter enter the Property at any reasonable time with or without prior notice. Reasons for entering the Property may include but is not limited to disaster response, damage assessment, debris removal, demolition, repair, mitigation of imminent threats to health and safety, mitigation of threats to the Property or surrounding properties, or rehabilitation of infrastructure (“Recovery Work”). I understand that this Agreement will remain in place for twenty-four (24) months from the date of this instrument.

Government Not Obligated to Perform: It is fully understood that this Agreement does not create an obligation for the Entities to perform Recovery Work. If determined necessary in accordance with Federal, State or local regulations, private property Recovery Work will be conducted at no expense to the Property Owner on the above-described property by personnel authorized by the Entities. In the event a Property Owner receives funds from insurance or another source to remove abandoned vessel debris as described here or to perform Recovery Work, the Property Owner will reimburse the applicable Entity as set out below in the section entitled Avoidance of Duplication of Benefit: Reporting Money Received.

Waiver, Indemnification Agreement, and Hold Harmless: I hereby agree to indemnify and hold harmless the Entities from any and all liability, claims, and damage that may result against any of the Entities related to their actions or omissions on the Property, including but not limited to any damage of any type whatsoever to the Property, personal property thereon or in the surrounding areas including fixtures, or for bodily injury or death to persons on the property. I release, discharge, and waive any action, either legal or equitable, that might arise by reason of any action or inaction of the Entities while performing Recovery Work, including incidental damage that may occur to yards, driveways, sidewalks, roadways, asphalt, or concrete. I acknowledge the risk of such incidental damage which may occur while Entities perform Recovery Work. Nothing in this Agreement shall be construed in any way to be a waiver of any Permittee’s applicable sovereign immunity, whether under federal, state, or local law.

Avoidance of Duplication of Benefits: Reporting Money Received: The undersigned understands that work performed by the Entities will not be charged for. Further, the undersigned understands that they have an obligation to file an insurance claim if coverage is available. The undersigned understands that if insurance proceeds or compensation from other sources for such Recovery Work are issued for the benefit of the Property, including private insurance, an individual or family grant program, or any other public or private assistance program, this could constitute a duplication of benefits which is prohibited by federal law. If any compensation from any source for recovery work or debris removal on this Property is issued, the undersigned agrees to report it to (850)815-4160.

Privacy Statement: The undersigned acknowledges that information submitted will be shared with other government agencies including state, federal, and local, along with their contractors, subcontractors, employees, or assigns. Sharing of such information will be for purposes of disaster relief management to meet the objectives of this Agreement.

Government Not Obligated; No Expense Except For Insurance Proceeds

The Property Owner/agent understands that this Right-of-Entry does not obligate the Governments/Contractors to perform debris removal. Governments/Contractors will access the property under this ROE if the work has been determined necessary in accordance with Federal, State, or local regulations. The Property Owners will not be charged for the work conducted by Governments/Contractors. By signing below I, am hereby certifying that I am the owner of the title property described below (“Title Property”) and that I, the Title Property Owner, have the legal authority to enter into this Consent and Waiver for Title Property (“Agreement”).

Right to Remove: I am granting permission to representatives of the United States, the State of Florida, the County, the municipality, their agents, contractors, and subcontractors (“Entities”) to remove or relocate the Title Property from its current location. Reasons for removing or relocating the Title Property may include but are not limited to disaster response, damage assessment, nuisance abatement, removal from private property which I do not own, mitigation of imminent threats to health and safety, mitigation of threats to the property which the Title Property is on or to surrounding properties, or rehabilitation of infrastructure (“Recovery Work”). I understand that this Agreement will remain in place for twenty-four (24) months from the date of this instrument.

Entities Not Obligated to Perform: I fully understand that this Agreement does not create an obligation for the Entities to perform Recovery Work. If determined necessary, in accordance with applicable federal, state, or local laws and regulations, Recovery Work related to the Title Property may be conducted at no expense to the Title Property Owner by the Entities. In the event a Title Property Owner receives funds from insurance or another source to remove or relocate the Title Property or to perform other Recovery Work, the I, Title Property Owner will reimburse the applicable Entity as set out below in the section entitled Avoidance of Duplication of Benefits; Reporting Money Received.

No Warranties as to Title Property: I understand that the Entities make no representations or warranties as to the condition, location, or status of the Title Property or the contents therein. I understand that neither this Agreement nor the Entities’ relocation or removal of my Tittle Property will create any legal relationship between myself and the Entities as it relates to the Title Property, including that of a bailment or otherwise. I understand that neither this Agreement nor an assessment performed by the Entities will create any obligation on the Entities’ behalf as it relates to the Title Property. I understand that the Entities are under no obligation to ensure the security or safekeeping of my Tittle Property. I understand that I am consenting to removal or relocation of my Title Property by the Entities and that this is being performed in conjunction with Recovery Work. I understand that the Entities are unable to guarantee the manner or method in which my Title Property will be removed or relocated and that I will not be consulted in the removal or relocation of my Title Property.

Consent to Waive Claims Under Applicable Laws or Regulations: I recognize that I may have been afforded additional rights under applicable federal, state, county, municipal, or local laws and regulations and that such laws may have otherwise afforded me additional time or rights as it relates to my Title Property. I hereby knowingly and intelligently waive and relinquish any and all rights or claims of due process as it relates to my Title Property, whether such rights or claims are now known or later become known to me.
