I attest that I am the owner of the residential property at the location noted in this tree

request, or that I have received explicit written permission to request a tree on his or her

behalf. Bridging The Gap, Inc. has offered to plant one tree (each, a “Tree”) on the listed property, paid for by the City of Merriam (the “City”).

I have accepted Bridging The Gap’s offer and I acknowledge and agree that:

(a) I have selected the type of Tree that I would like to have planted on the property;

(b) I have consented to the location on the property of each Tree planting;

(c) I have consented to allow Bridging The Gap approval to access my yard as needed for the planting and quarterly health inspections;

(d) I am solely responsible for watering and otherwise caring for each Tree after its planting;

(e) Bridging The Gap is not obligated to move or remove any Tree that it plants on the property if I later decide that such action is necessary or desirable;

(f) if I encounter any problems with any Tree and email Bridging The Gap at trees@bridgingthegap.org regarding the specific problems, I understand Bridging the Gap will provide an assessment and advice on steps that may be taken to improve the health of each Tree;

(g) if any Tree should die during the first 12 months following its planting, excluding death owing to vandalism, severe weather, improper care, unintentional injury or auto impacts, Bridging The Gap will replace the Tree, one time, at no cost, provided that written notice from me of the Tree’s death is received by Bridging The Gap within that twelve month period; and

(h) Bridging The Gap and the City, having provided me with one or more Tree plantings at no cost, shall have no liability or responsibility to me whatsoever for any damage to person or property that any Tree planted by Bridging the Gap may cause in the future;

(i) I understand that photos may be taken during the planting of either myself or the tree on my property, and I hereby grant Bridging The Gap and Heartland Tree Alliance the irrevocable and unrestricted right to use and publish photographs of me, or in which I may be included, for editorial, trade, advertising, and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. I hereby release Bridging The Gap and Heartland Tree Alliance from all claims and liability relating to said photographs.
