RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT
BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY.
This Agreement is entered into by and between California Service Dog Academy, a non-profit organization with its principal place of business in the State of California, County of Tulare (hereinafter referred to as "CSDA"), and the undersigned participant, including the parent or guardian of any minor participants (hereinafter collectively referred to as "Participant").
1. Acknowledgment of Risks: Participant acknowledges that interacting with and training service animals involves known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to themselves, to property, or to third parties. Participant understands that such risks cannot be eliminated without jeopardizing the essential qualities of the activity. These risks include, but are not limited to, animal bites, falls, injuries from equipment, and the potential of allergic reactions.
2. Release and Waiver: Participant hereby voluntarily releases, forever discharges, and agrees to indemnify and hold harmless CSDA from any and all claims, demands, or causes of action, which are in any way connected with Participant's participation in CSDA activities, or Participant's use of CSDA's equipment or facilities, including any such claims which allege negligent acts or omissions of CSDA.
3. Indemnification: Participant agrees to indemnify and hold CSDA harmless from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of Participant or otherwise.
4. Minor Participants: If the Participant is a minor, the undersigned parent or guardian acknowledges that they are also subject to all the terms of this Agreement, to the extent applicable, and have instructed the minor participant on the above risks and his or her responsibility to participate in a safe manner. By signing this Agreement, said parent or guardian also releases and waives any potential claim that might arise as they have contracted for the minor participant to be involved in CSDA activities and have agreed to the foregoing on the minor's behalf.
5. Medical Release: In the event of an injury to the minor or adult participant, Participant hereby grants authorization to CSDA and its representatives to procure medical treatment deemed necessary and agrees to be financially responsible for any medical or legal bills that may result from such treatment.
6. Photo Release: Participant grants CSDA the right to photograph, videotape, and/or record Participant and to use Participant's likeness in photographs, video recordings, or electronic images in any and all of CSDA's publications, including website entries, without payment or any other consideration. Participant understands and agrees that these materials will become the property of CSDA and will not be returned.
7. Jurisdiction and Arbitration: This Agreement shall be governed by and interpreted in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively through binding arbitration conducted in Tulare County, California, in accordance with the rules of the American Arbitration Association.
8. Acknowledgment: Participant has read this Release of Liability and Waiver of Claims, fully understands its terms, and understands that Participant is giving up substantial rights, including the right to sue. Participant acknowledges that they are signing the agreement freely and voluntarily, and intend by their signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
IN WITNESS WHEREOF, Participant has executed this Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement on this date and time of submission and seal.
