Section 4: Intellectual Property

In order to apply for certification against the RRN Training Standards you must:
  • Ensure compliance with intellectual property laws, including the Copyright, Designs & Patents Act 1988 and the Trade Marks Act 1994
  • Not infringe the intellectual property rights, including copyright or trade marks of any organisations delivering training within the field, whether they are accredited training programmes or not.
  • Refrain from using any copyright materials or trademarks owned by someone other than your organisation without their explicit written permission.
  • Ensure permission is sought and granted for the use of materials developed or owned by others who have asserted their rights
  • Where permission has been granted, declare, and reference the use of materials owned by others appropriately within the documentation provided as evidence for the application

Section 5: Terms and Conditions

Key Obligations

The following Terms and Conditions must be read and interpreted in conjunction with the Restraint Reduction Network Standards.

The training provider shall

  • Read the Bild Association of Certified Training (ACT) Agreement (provided to you) which training providers must sign up to (unamended) upon certification.
  • Accept that by proceeding with the application, they will be bound by that Agreement upon certification and that information provided to Bild ACT in this Certification Eligibility Form and during the application process will be relied upon by Bild ACT in determining whether to grant certification and in entering into that Agreement.
  • Accept and understand that they have 6 months to submit the completed self- assessment form after receiving the login details (NOTE, extensions may be permitted at the Certification Directors discretion, further to a written request as outlined in the Customer Handbook. Additional charges may be levied).
  • Accept and understand that an application for certification should be fully completed within 12 months from formal intention to proceed and payment of fees (NOTE, extensions may be permitted at the Certification Directors discretion, further to a written request as outlined in the Customer Handbook. Additional charges may be levied).
  • Permit Bild ACT and its auditors to assess the training courses to be operated by the Certified Training Service to ensure that the content, length and quality of the courses conform to the standards required by Bild ACT and the Restraint Reduction Network Training Standards and the evidence submitted to the panel for certification.
  • Advise Bild ACT if it is unable to comply with any requirement of the Scheme, the Restraint Reduction Training Standards.
  • Nominate an employee to be the Training Manager who shall be authorised to liaise with Bild ACT concerning Certification, the Scheme and the Restraint Reduction Training Standards.
  • Inform Bild ACT of any changes that may affect the Certification. Such changes include management and organisational changes, location, ownership etc. within 30 days.
  • Inform Bild ACT within 10 working days when Senior Trainers join or leave the organisation. This status is non- transferrable across organisations, employers or other training organisations. Senior Trainers who deliver Certified training programmes/ curriculums will be listed with Bild ACT once accepted by Bild ACT as a Certified Senior Trainer.
  • Respond to any compliance updates issued by Restraint Reduction Network Training Standards and Bild ACT within 30 days and complete any agreed corrective action within 60 days.
  • Inform its clients of any suspension or termination of certification without delay.
  • Notify Bild ACT of any significant non-conformities identified through internal audit or review e.g. review of client feedback without delay.

Payment of fees

  • The Certified Training Provider shall pay Bild ACT a one off application fee and an annual fee in full and by the due date in accordance with the payment structure. Failure to do so may result in the removal of certified status.
  • Bild ACT reserves the right to issue a further invoice to the Certified Training Provider if on an assessment, it is apparent that the category of the organisation has changed or there is significant none conformity which will require additional assessment and therefore the annual fee paid was inappropriate.
  • Bild ACT reserves the right to invoice the Certified Training Provider for interest at 6% per annum accruing daily and compounded from month to month from the due date for any annual fee or other sum due that is not paid on the due date.

Use of logos

  • Organisations may use particular logos that are relevant to their current status, or stage in the certification process. To do this organisations shall comply with the formal guidance on the use of the logo issued by Bild ACT, and any updates.
  • The appropriate logo may be used on the organisation’s webpages or printed materials, but if an organisation is not yet certified the logo must always be used in conjunction with this text: "[Organisation] is working towards certification against the Restraint Reduction Network Training Standards".
  • Organisations (certified or certifying) must undertakes to discontinue any use of the scheme logo or any reference to scheme which is unacceptable to Bild ACT.

Bild ACT shall

  • Observe strict confidentiality concerning the organisations operations, subject only to limited exceptions - see the Bild ACT Training Agreement. NOTE/.   • Provide updates on the Restraint Reduction Network Training Standards and may provide opportunities for the Certified Training Service to attend Continuous Professional Development events at their own cost
  • The certification team can support applicants by providing them with information and guidance about the certification scheme. This can include:
    • Answering queries relating to the Bild ACT procedural handbook.
    • Advising on timescales for applications. Clarifying aspects of the process for certification.
    • A feedback meeting with the assessor (if required), following an unsuccessful application. The meeting will last no more than two hours. Minutes will be taken and produced as a record of feedback given.
    • All contacts relating to advice and support are logged by Bild Association of Certified Training and the certification team.
  • Bild ACT does not get involved in disputes (defined below) between Certified Training Services, applicants or third parties in relation to any claimed intellectual property rights.

  • INDEMNITY: The parties agree that Bild ACT (or Bild) shall not be liable for any cost, demands, proceedings, interest, court fees or any other sums (“Costs”) that may arise directly or indirectly from any Dispute or that Bild ACT may suffer or incur in order to defend itself against any claims or allegations in relation to any Dispute and the Certified Training Service shall fully and unconditionally indemnify Bild ACT on demand for any such Costs.
